This includes the careful, strictly confidential and sensitive handling in accordance with applicable data protection regulations of the EU General Data Protection Regulation of all personal data to protect privacy.
With the following instructions, we inform you about the processing of your personal data by Falkenstein Personalberatung and the rights to which you are entitled under data protection law. Personal data is any data with which you can be personally identified.

Data deletion/duration of data storage
The data stored by us will be deleted as soon as it is no longer required for its intended purpose (e.g. completion of an application procedure) and the deletion is not opposed by any statutory retention obligations or other legitimate interests of Falkenstein Personalberatung – for example, a duty to provide evidence in proceedings under the General Equal Treatment Act (AGG) – or the user has expressly consented to longer storage.
If an applicant has indicated his or her consent to the storage of his or her personal data with the declaration of consent under data protection law, this data will be deleted as soon as the applicant revokes his or her consent to data storage vis-à-vis Falkenstein Personalberatung. Mandatory legal provisions – in particular retention periods – remain unaffected. Deletion may also be carried out by Falkenstein Personalberatung, e.g. because the successful placement of an applicant is no longer expected.
Contact
When contacting us (phone / e-mail), your information including your contact details will be stored for the purpose of processing the request and in case of follow-up questions. We do not pass on this data without your consent.
The processing of the data transmitted to us is therefore based exclusively on your declaration of consent pursuant to Art. 6 para. 1 a) DSGVO. You can revoke this consent at any time. For this purpose, an informal communication by e-mail to us is sufficient. The legality of the data processing operations carried out until the revocation remains unaffected by the revocation.
The data you have transmitted to us will remain with us until you request us to delete it, revoke your consent to store it, or the purpose for storing the data no longer applies (e.g. after we have completed processing your request). Mandatory legal provisions – in particular retention periods – remain unaffected.
Security measures
Falkenstein Personalberatung takes organizational, contractual and technical security measures in accordance with the state of the art to ensure compliance with data protection laws and to protect the data we process against accidental or intentional manipulation, loss, destruction or against access by unauthorized persons.
The security measures include in particular the encrypted transmission of data between your browser and our server. Our website uses SSL or TLS encryption to protect the transmission of confidential content, such as requests that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.
If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.
Nevertheless, internet-based data transmissions can have security gaps, so that absolute protection cannot be guaranteed. For this reason, every user is free to transmit personal data to us in alternative ways, e.g. by telephone.
Disclosure of data to third parties and third countries
Data is only passed on to third parties within the framework of legal requirements. We only pass on users’ data to third parties if, for example, this is necessary on the basis of Art. 6 para. 1 lit. b. DSGVO is necessary for contractual purposes or on the basis of legitimate interests pursuant to Art. 6 para. 1 lit. f. DSGVO in the economic and effective operation of our business.
In principle, application data will only be forwarded to the internal departments of our company responsible for the application process. Application data will only be forwarded to external recipients or other third parties if the applicant has expressly declared his or her consent to the forwarding of his or her data in advance. Personal data will not be passed on to third parties beyond this.
If we use subcontractors to provide our services, we take suitable legal precautions and appropriate technical and organizational measures to ensure the protection of personal data in accordance with the relevant statutory provisions.
We only transfer personal data to service providers and other third parties outside the European Economic Area (EEA) under certain conditions: The user has expressly declared his or her consent to the transfer of data to a third country, or the EU Commission must confirm an adequate level of data protection for the respective third country, or other appropriate data protection guarantees must be in place (e.g., binding corporate data protection provisions of the EU standard contractual clauses).
Online presences in social media
In addition to our corporate website, we maintain online presences within social networks and platforms in order to be able to communicate with customers, interested parties and users active there and to inform them about our services there. When calling up the respective networks and platforms, the terms and conditions and data processing guidelines of their respective operators apply.
If users communicate with us within the social networks and platforms, e.g. by sending us messages, we process the users’ data.
Collection of access data and server log files
Each time you access our website, the provider automatically records information in so-called server log files, which your browser automatically transmits to us. The stored information includes the name of the website accessed, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user’s operating system, referrer URL (the previously visited page), IP address and the requesting provider.
This data is not merged with other data sources.
For security reasons (e.g. for the clarification of abuse or fraud) log file information is stored for the maximum permissible duration and then deleted. Data whose further storage is required for evidentiary purposes is excluded from deletion until final clarification of the respective incident.

The respective provider or operator of the sites is always responsible for the content of the linked sites. The linked pages were checked for possible legal violations at the time of linking. Illegal contents were not recognizable at the time of linking. However, a permanent control of the contents of the linked pages is not reasonable without concrete evidence of a violation of the law. If we become aware of any infringements, we will remove such links immediately.
Change of the privacy policy
We expressly reserve the right to amend this data protection declaration in order to adapt it to changing legal situations or in the event of changes to the service and data processing. However, this only applies with regard to declarations on data processing. Insofar as user consents are required or components of the data protection declaration contain provisions of the contractual relationship with the users, the changes will only be made with the consent of the users.
Users are requested to inform themselves regularly about the content of the data protection declaration.
